Cette étude vise à expliciter les relations entre les deux versions arabes et la traduction hébraïque anonyme du XIVesiècle, en prenant en compte les additions et remaniements qui les différencient. Je conclus que la traduction hébraïque représente un stade intermédiaire de réélaboration: elle atteste d'importants ajouts et modifications philosophiques, spécialement dans les arguments portant sur la création du monde, au début de (...) l'ouvrage, mais précède l'achèvement de la révision du traité, qui a conduit aux remaniements dont témoigne la dernière version arabe, dans les chapitres abordant les questions épineuses de la corporéité divine et de la direction. L'étude des ajouts et des arguments du point de vue du contenu, du contexte et de l'argumentation contribue également à comprendre l'histoire de la stratification des phases rédactionnelles de l'ouvrage et la manière dont l'ouvrage a été transmis. The 1948 Declaration of Human Rights demanded a collaboration among exponents from around the world. Embodying many different cultural perspectives, it was driven by a like-minded belief in the importance of finding common principles that would be essential for the very survival of civilization. Although an arduous and extensive process, the result was a much sought-after and collective endeavor that would be referenced for decades to come. Motivated by the seventieth anniversary of the 1948 Universal Declaration of Human Rights and (...) enriched by the contributions of eminent scholars, this volume aims to be a reflection on human rights and their universality. The underlying question is whether or not, after seventy years, this document can be considered universal, or better yet, how to define the concept of “universality.” We live in an age in which this notion seems to be guided not so much by the values that the subject intrinsically perceives as good, but rather by the demands of the subject. Universality is thus no longer deduced by something that is objectively given, within the shared praxis. Conversely, what seems to have to be universal is what we want to be valid for everyone. Reconstruction of human ecosystems and their stability over time provides knowledge of the processes of adaptability developed by isolated communities. Seasonality of vital events is a good indicator of the effects of different lifestyles, which in turn depend on the ecological context in which a population developed specific subsistence models. Seasonality of births reflects the cultural attitude towards the best time to conceive, in relation to work activities and loads; the latter may also affect physiological functions related to fertility. The (...) present research concerns gross birth rates and seasonality of births and conceptions during four centuries in south-central Italy. Birth rates were between 33·0 and 36·5 per 1000. The pattern of seasonality of births and, by extension, of conceptions defines a southern-type agricultural area for the earlier periods. However, it also shows a progressive shift towards an increasing concentration of conceptions in spring namely from April to August – with a large increase in summer in the 19th century with respect to the previous periods. The new 19th century pattern is reported by Crisafulli, Dalla Zuanna & Solero (2000) as being representative of the central Adriatic region, a geographical classification to which Abruzzo can also be attributed. Following closely the footprint of the traditional New Testament reflection in Rom. 10,16 and in Io. 12,37 (= Is. 53,1), Justin inserts the poem of the SufferingServant (Is. 52,13-53,12) within his account of the paradoxical and problematic refusal of Israel (1 apol. 50,2.3-11; 51,1-5; 52,3), and within a impressive baptismal catechesis (dial. 13,2-9), the most primitive echo of which is seen in Act. 8,26-40. Notwithstanding the view offered by other scholars, the Christian hermeneutics of Is. 53, has played an incisive (...) role in the theological reflection of the first Christian community. Justin witnesses to its use within a reflection that takes into consideration the tension and negativity among early Christians surrounding the relationship between the two Testaments. He overcomes this tension by pointing out the perfect harmony between them, the essence of which is found in the prophecy of the Servant of YHWH. (shrink)

In Etym. 3.53.1 and Nat. 18.1, Isidore of Seville describes the nature of moonlight, primarily drawing on Augustine’s commentary on Psalm 10. In the chapter of De natura rerum, he also explores specific allegorical meanings of the moon, already established in patristic exegesis, particularly referencing the symbolism of the resurrection of the dead. To indicate the shining part of the moon’s surface, Isidore employs the rare adjectival compound lucifluus, first attested in Juvencus’ Evangeliorum libri with reference to the sun and, (...) metaphorically, to the Gospel. Significantly, this adjective is already used in a context similar to Isidore’s, in the second sermon (De resurrectione) of the first book of the Tractatus by Zeno of Verona (Tract. 1.2.19). In this sermon, the author offers a brief allegorical excursus on the moon, interpreting it as a symbol of mortal man and his future resurrection at the end of time. With some distinctions, he uses the same adjective to describe the brightness of the sun in relation to that of the moon. This close analogy in context and content suggests that Isidore, particularly in the passage from De natura rerum, might have considered Zeno’s sermon when reusing the term lucifluus. (shrink)

In the last 2500 years, since the beginnings in ancient Greece of the literary genre we call “history,” the relationship between history and law has been very close. True, the Greek word historia is derived from medical language, but the argumentative ability it implied was related to the judicial sphere. History, as Arnaldo Momigliano emphasized some years ago, emerged as an independent intellectual activity at the intersection of medicine and rhetoric. Following the example of the former, the historian analyzed specific (...) cases and situations looking for their natural causes; following the prescriptions of the latter—a technique, or an art, born in tribunals—he communicated the results of his inquiry.2Within the classical tradition, historical writing had to display a feature the Greeks called enargeia, and the Romans, evidential in narrtatione: the ability to convey a vivid representation of characters and situations. The historian, like the lawyer, was expected to make a convincing argument by communicating the illusion of reality, not by exhibiting proofs collected either by himself or by others.3 Collecting proofs was, until the mid-eighteenth century, an activity practiced by antiquarians and erudite, not by historians.4 When, in his Traité des differentes sortes de preuves qui servent à établir la vérité he l’histoire , the erudite Jesuit Henri Griffet compared the historian to a judge who carefully evaluates proofs and witnesses, he was expressing a still-unaddressed intellectual need. Only a few years later Edward Gibbon published his Decline and Fall of the Roman Empire, the first work that effectively combined historical narrative with an antiquarian approach.5 2. The Genesis of the Social and the Carnal Donation of the Non-Presentable. The Range of the Notion of Institution in Merleau-PontyThis article examines the range of the notion of institution that Merleau-Ponty proposes in his course at the Collège de France (1954-55), by notably insisting on the importance of the question of the genesis of the social for the deepening of his thought. By broadening his investigative domains in two complementary directions (that is, lateral passivity and socio-historical institution), Merleau-Ponty aims (...) in this course to grasp in a better way the lateral relations of our Urstiftung (originary institution) and the instituting subject who obliquely goes beyond the institution towards its sense. That leads him to introduce the perceptual field as being essentially lacunary, because it marks a place where the consciousness is present at the divergence in relation to consciousness. It is certain that the Phenomenology of Perception addressed this question by considering the social as a place where “I am given to myself”. However, the psychological starting point of this work, as well as the originary temporal and unilateral character of radical reflection, prevented one from really grasping the institutional junction of the concrete event and the symbolic matrix. One was not able to thematize an auto-articulation which appears suddenly between radical reflection and the unreflective. This is why Lévi-Strauss’ structuralist thought, by considering the social as symbolism, allows for a better understanding of this institutional nexus. But this idea does not lead to the dogmatic positing of the reality and the autonomy of the social. Instead, it encourages us to practice “the perception of history,” which consists in guessing, in the very process of sociological idealization, the carnal and wild donation of the non-presentable. Far from returning to psychologism, this perception aims at actively achieving the movement internal to the symbolic, that is, its incarnation.La genesi del sociale e la donazione carnale del non-presentabile. Quest’idea non conduce però a porre dogmaticamente la realtà e l’autonomia del sociale, essa incita piuttosto a praticare “la percezione della storia” che consiste nell’individuare, nel processo stesso dell’idealizzazione sociologica, la donazione carnale e selvaggia del non-presentabile. Franco “Bifo” Berardi tells us that the current transformation of every domain of social life into economy has led to “the subjugation of the soul to work processes.” There is a newfound love of work and, consequently, writes Berardi, “no desire, no vitality seems to exist anymore outside of the economic enterprise.” Concerned as it once was with “fostering the soul,” and concerned as it now is with preparing students for the job market, what role might education have in Berardi’s (...) musings? Can “creativity,” “self-actualization” and “curiosity,” which are so valued in education, still speak and help foster a sense of the soul that exceeds economy and work? In this paper, I explore these questions by providing an account of what is at stake in Berardi’s conception of the soul and its subjugation to work. I draw on his ideas to critically appraise the seemingly-benign aspirations of the “creative class,” a term coined to signal a new era for human flourishing afforded by shifts towards personal creativity in the digital economy. I then move to consider how, in particular, the ubiquitous promotion of “creativity” and “curiosity” in education tends to replicate a form of learning that puts the soul to work, as it were, promoting a narrow, self-enterprising subject with a frantic instrumental orientation towards the world. I conclude with a discussion on how demands on learners, to be always curious, innovative, nimble and open to discovery lead to panic, collapse and depression: the diseases of the soul. (shrink)

The 21st century is characterized by an unpredictable and challenging work environment, and the Intrapreneurial Self-Capital (ISC) career and life construct can be seen as a core of individual intrapreneurial resources that enables people to cope with ongoing challenges, changes, and transitions founding innovative solutions when confronted with the constraints imposed by such an environment. The ISC is a challenging construct since it can enhance behavior and attitudes through specific training, unlike personality traits, which are considered substantially stable in the (...) literature. Against this background, the present study examined the relationship between ISC and well-being (hedonic well-being and eudaimonic well-being) controlling for the effects of personality traits. The Big Five Questionnaire (BFQ), the Intrapreneurial Self-Capital Scale (ISCS), the Satisfaction With Life Scale (SWLS), and the Flourishing Scale (FS) were administered to 258 Italian workers. Hierarchical regression analyses showed that ISC explained a percentage of incremental variance beyond that explained by personality traits in relation to both life satisfaction and flourishing. These results indicate that ISC is a key resource for hedonic well-being and eudaimonic well-being and that it offers new research and intervention opportunities. (shrink)

In December 2017, Law 219/2017, ‘Provisions for informed consent and advance directives’, was approved in Italy. The law is the culmination of a year-long process and the subject of heated debate throughout Italian society. Contentious issues are addressed in the law. What emerges clearly are concepts such as quality of life, autonomy, and the right to accept or refuse any medical treatment – concepts that should be part of an optimal relationship between the patient and healthcare professionals. The law maximizes (...) the value of the patient’s time to decide. Every patient is allowed to make choices for the present as well as for the future, conceived as a continuation of the present, and to decide what comes next, based on what he/she already knows. The law identifies three distinct but converging paths towards the affirmation of a care relationship based on reciprocal trust and respect: the possibility to consent to or refuse treatment, the shared care planning, and advance directives. The fundamental point to emerge from the new Italian law is that consensus is an essential connotation of the treatment relationship. Consensus is not limited to the acceptance/rejection of medical treatment but is ongoing. It is projected into the future through shared care planning and advance directives which act as tools for self-determination and the manifestation of the beliefs and preferences of persons unable to express their will. These principles are in line with the idea of appropriate care as evaluated from two different perspectives, one of scientific adequacy and the other commensurate with the individual’s resources, fragility, values, and beliefs. Surely, however, the new law is not the end of the matter on issues such as conscientious objection, which is deeply rooted within the Italian cultural and political debate. In this regard, healthcare institutions and policymakers will be called upon to develop and implement organizational policies aimed at the management of foreseeable conscientious objection in this field.
